Terms and Conditions
These are the terms and conditions (the “Terms and Conditions”) that govern the relationship between you, the entrant (“you”, “your(s)”) and Norton Way Motors Limited, Norton Way North, Letchworth, Hertfordshire, SG6 1BL (the “Promoter”, “we”, “our”, “us”) in respect of the Promotion.
ELIGIBILITY
1. The Promotion is only open to residents in the United Kingdom aged at least eighteen (18) years who hold a bank account in the United Kingdom.
2. The following are not eligible to participate in this Promotion: (i) employees of the Promoter, its respective subsidiaries, associated companies and dealerships or any advertising and promotional agencies and (ii) immediate family members of such employees or of anyone with whom such employees are domiciled. In these Terms and Conditions, “immediate family” includes mother, father, brothers, sisters, sons, daughters and spouse.
3. The Promoter assumes that by entering the Promotion you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).
PROMOTION PERIOD
4. The Promotion opens at [9am] GMT on 24 November 2023 and closes at [5pm] GMT on 31 December 2023 (the “Promotion Period”).
HOW TO ENTER
5. To participate in the Promotion you will need to complete the purchase of a new or used retail vehicle (car or motorcycle) from one of our authorised dealerships during the Promotion Period (each a "Vehicle"), regardless of when your initial order was placed (an "Entry"). A purchase will be completed when a final invoice for the Vehicle is submitted to you and paid in full. A list of our authorised dealerships can be found here: https://www.nortonway.com/locations/
6. We will automatically enter you into the Promotion upon completion of your Entry, provided that you have given us a valid name and valid email address, that the name that you submit is the authorised account holder of the corresponding email address, and you consent to receive an email from us.
7. No entry fee is required to participate in the Promotion.
8. Only Entries completed during the Promotion Period will be accepted into the Promotion. Any Entry falling outside the Promotion Period shall be ineligible.
9. The Promotion is restricted to one (1) Entry per person.
PRIZE
10. There is a total of one (1) prize of ten thousand pounds sterling (£10,000) to be won during the Promotion (the "Prize").
PRIZE DRAW
11. The prize draw will take place within seven (7) days of the last day of the Promotion Period at the Promoter’s offices at the address set out above. The winner will be selected at random from all eligible Entries received during the relevant Promotion Period using a random computer process.
12. We will endeavour to notify the winner by email or telephone within seven (7) days of the date of the prize draw. The winner will be required to notify us with details of the bank account to which the Prize should be sent. We will endeavour to transfer the Prize by bank transfer to the nominated bank account within seven (7) days of such notification date. You shall be responsible for any bank fees relating to the transfer.
13. If the winner cannot be contacted after two (2) attempts within fourteen (14) days of the draw date, we reserve the right to select an alternate winner from all remaining Entries using the same method (except for time periods) described in paragraph 11 above.
14. We also reserve the right to select an alternative winner in the event that we have reasonable grounds for believing that the winner has contravened any of these Terms and Conditions.
15. The receipt by the winner of the Prize is conditional upon compliance with any and all relevant laws, rules and regulations.
16. The name and home county of the winner will be available for one (1) month after the end of the prize draw at the following website: www.notonway.com
GENERAL
17. By participating in the Promotion, you agree to be bound by these Terms and Conditions and by our decisions, which are final in all matters relating to these Terms and Conditions, the Promotion, the draw and/or the results and no correspondence or discussion shall be entered into.
18. We accept no responsibility for any incorrect or inaccurate information or lost or late Entries and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, line failure, theft or destruction or unauthorised access to Entries lost or delayed whether or not arising during operation or transmission as a result of server functions, or for technical, network, telephone equipment, electronic, computer hardware or software malfunctions, virus, bugs or other causes outside its control or failure to receive Entry information by us on account of technical problems or traffic congestion affecting the Entry collection process.
19. Personal information collected from entrants will be used by the Promoter solely in connection with the Promotion in accordance with the Promoter’s privacy statement at https://www.nortonway.com/site/privacy-policy/ and will not be disclosed to any third party except for the purpose of fulfilling the prize where applicable.
20. You shall at all times act in accordance with all applicable laws in the United Kingdom. We may terminate any agreement with you with immediate effect should we, in our sole discretion, deem that you have contravened any applicable laws. We shall not be liable for any direct or indirect losses incurred by you arising out of any termination under this rule.
21. By entering this Promotion, you agree to the use of your name, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation and as required by the Promoter if you are declared a winner.
22. These Terms and Conditions shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.
